Housing Capacity Preservation Amendment Act of 2025

New Bill Seeks to Limit HPRB Authority in Historic Districts

Ward 1 Councilmember Brianne Nadeau and co-sponsors Anita Bonds, Christina Henderson and Kenyan McDuffie have introduced a bill intended to limit the HPRB’s ability to determine that a new construction project within a historic district is “incompatible” with Preservation Law if doing so would result in a reduction of floor area ratio, residential square footage, or dwelling unit density below what is currently permitted by zoning regulations or previously granted by the Zoning Commission or Board of Zoning Adjustment.

The bill also removes “height” as a factor in defining historic preservation considerations.

The bill does not affect residential alteration or building addition projects in historic districts.

The bill has been referred to the Committee of the Whole for further consideration.

Nadeau introduced a similar bill last year (25-0919 – Housing Capacity Preservation Amendment Act of 2024) that failed to gain traction.
